Detained or Arrested in Israel: The First Steps
Stress encourages rushed decisions and explanations. In the first hours, it is especially important to understand your status and obtain legal advice.
Do not resist or explain everything in passing
A person whose freedom has just been restricted often tries to persuade officers immediately. Fragmented explanations in a corridor, police vehicle or in front of others may later become part of the evidence.
Do not resist physically and comply with lawful instructions. Try to establish whether you are detained or arrested, why, and where you are being taken.
Ask to consult a lawyer
The timing and scope of consultation depend on the circumstances and legal status. State clearly that you wish to speak to a lawyer. Advice is most useful before a detailed account, not after it.
I explain what is happening, what the police may decide next and what may be relevant if a court considers extending detention.
What relatives can do
- identify the police station and unit;
- record the time and circumstances of detention;
- prepare information about health conditions and medication;
- avoid discussing the allegation on social media;
- send the lawyer every document and investigating officer’s details.
Earlier advice creates more options
Early representation can help with questioning, preservation of evidence, possible alternatives to continued detention and preparation for a court hearing.
